eBookquet Network Limited, (hereafter referred to as “eBookquet Network, eBookquet, We, Our, Us, or Platform”). eBookquet Network Limited (“eBookquet Network”) sets out its Intellectual Property Rights Policy (“IPR Policy”) to govern the relationship and policies between eBookquet Network, its “Authors” (including Authors, Writers, Publishers, Rights Holders, or Content Owners), and any user of its infrastructure and services that relate to intellectual property rights. Our Intellectual Property Rights, as well as the usage of other eBookquet Network Limited Policies (Terms and Conditions, and Data Privacy Policies) are collectively and hereafter, referred to as the “Terms” or “Policy” of eBookquet Networks Limited.
At eBookquet Network, we create a dynamic ecosystem for knowledge exchange, prioritizing intellectual property rights and author autonomy. Our platform allows authors to retain control over their work, including pricing, marketing, and distribution, while protecting their rights and interests. By doing so, we unite readers and authors worldwide, promoting a love for reading and storytelling.
We recognize the importance of protecting intellectual property rights and ensuring that our platform complies with applicable laws and regulations. This IPR Policy outlines the guidelines and procedures for protecting intellectual property rights on our platform. The IPR Policy applies to the use of eBookquet Network web and mobile applications to host and distribute e-books, courses, videos, publications, articles, and materials collectively called “Contents” by authors, writers, publishers, or rights holders. All authors are subject to these Terms and the regular rule update published by eBookquet for the running of eBookquet Network services.
eBookquet Network reserves the right to cancel or amend all or any part of the IPR Policy without prior notice. Any changes to the IPR Policy will be posted on the eBookquet website or via newsletter. eBookquet is not liable for copyright infringement or intellectual or data breach outside these Terms.
By using eBookquet Network applications and services, you acknowledge that you have read and understood the Terms, and agreed to be bound by the Terms governing the use of eBookquet Network which, herein referred to as “Contract Agreement”.

Definition
• Intellectual Property (IP): Includes but not limited to creations of the mind, such as literary works, including books, courses, videos, articles, publications, excerpts, and notes that have protection rights.
• Copyrights: A specific type of IP right that protects original literary works, such as books, courses, videos, articles, publications, excerpts, and notes that have protection rights.
• Content: Any e-books, courses, videos, publications, articles, text, images, or other materials uploaded and/or generated by authors or users.
• Author: A creator or rights holder of content.
• Rights Holder: Individual or entity that has copyrights for content.
• Publisher: Individual or entity that publishes or produces content
• User: Any individual or entity who accesses or uses eBookquet Network Services and Content.
• Fair Dealing or Use: includes but not limited to excerpts or notes from books for private use, non-commercial research and private study, criticism or review, or use of content with expired copyrights.
• Bookstore: A front store where an author uploads and sells content.
• Content License Agreement: An agreement between an author (including anyone who has the permission of the author to assign the right over the literary work) and eBookquet Network the right to host, publicly display, and distribute content.
Author Account
This is an account where verified content owners or merchants upload their content and set prices in the Knowledge Networking Marketplace. Registration requires first name, last name, date of birth, location, a valid email address, a secure alpha-numerical password, and submission of a government-issued ID for KYC (Know Your Customer) verification. Users must provide accurate, truthful, and verifiable information.
Age Authorization: Authors, publishers, or content right holders who are less than 18 years will NOT be allowed to create an Author Account and manage a bookstore in the Knowledge Networking Marketplace (Knet Mart). If you are an Author, publisher, or rights holder, you would require an adult with legal rights to your content to create an account, set up a bookstore, and manage your content.
By creating an author account and using the services, you confirm that you are at least 18 years with the authority, right, and capacity to enter into this contract and abide by all the relevant terms of our policies. Inaccurate or outdated information may lead to account termination.
Content Ownership and Rights
Intellectual property and copyright play a critical role in defining the relationship between authors, eBookquet Network, and users. By uploading, publishing, or distributing content through eBookquet Network applications, authors agree to certain terms of service, which dictate how eBookquet Network distributes their works.
eBookquet Network Ownership: eBookquet Network and its licensors retain all rights, title, and interest in their intellectual property, including patents, copyrights, trademarks, trade secrets, and other proprietary rights, as embodied in the API, Services, Dashboard, and the Application’s original content, including text, names, images, and software. ("eBookquet Network Intellectual Property"). This intellectual property is protected by law, and all rights not explicitly granted to you are reserved by eBookquet Network Limited.
Author Ownership: Authors retain ownership of the intellectual property rights in their uploaded content, including books, courses, publications, articles, and any other materials.
i. Authors have the intellectual property rights or license to the content they host or share, and have the authority to grant eBookquet Network the right or license to the content.
ii. Author retains rights, grants eBookquet distribution license; users allowed fair and non-commercial use.
iii. Using eBookquet Network services to host or share content does not infringe or violate the applicable rights, including but not limited to, copyrights, ownership, patents, rights of publicity or privacy, or any other intellectual property rights of any individual or entity –tangible or intangible.
iv. Authors have the right to take down their content if it does not violate the rights of eBookquet Network and users whose active access subscriptions have not expired.
User Rights: Our services are open to any potential user who can create an account and use eBookquet Network services.
i. Users have the right to the content they subscribed to, based on the terms of the subscriptions, and use it fairly for private or non-commercial purposes.
ii. Creative Commons Attribution: subject to the rights reserved by the authors, users have the right to use, modify, distribute, and give attribution to the original author.
iii. Creative Commons Zero: Authors waive all rights, dedicating the content to the public domain and users.
iv. Public Domain Content: Users have the right to use, modify, reproduce, copy, and use fairly any content whose copyrights have expired.
v. Content Fair Use: Users have the right to reuse user-generated content for criticism, commentary, or educational purposes.
vi. Users retain ownership of their user-generated content, but grant eBookquet Network a non-exclusive license to use, modify, and distribute such content within the Applications.
vii. Users are required to respect the intellectual property rights of authors, creators, and other users. No copyright infringement or plagiarism is allowed or tolerated.
Trademarks and Copyrights

i. eBookquet Network and the Application logos, and names are the trademarks of eBookquet Network Limited
ii. All content, including texts, images, and software, is protected by copyright
iii. eBookquet Network trade dress shall not be used with any product or services without the prior written consent of eBookquet Network Limited
Copyrights
All content and materials are held as the intellectual property of their respective owners or right holders. Therefore, unauthorized reproduction, distribution, or commercial use of this content and materials is strictly prohibited.
Attestation: By uploading content on eBookquet network applications, each author attests that their content:
i. is their own original works and they have the copyrights.
ii. or information supplied is true and correct in all material respects.
iii. does not infringe or violate the rights of any third party, including but not limited to, ownership, copyrights, trademarks, patents, logos, licensing rights, rights of publicity or privacy, or any other intellectual property rights.
iv. is not contrary to any applicable laws.
Content Guidelines
eBookquet Network provides access to a wide range of services, including but not limited to e-books, courses, publications, and audio-video materials. All such materials owned or provided by third parties (authors) are collectively referred to as “Content.”
Originality: Authors must ensure that their uploaded content is original and does not infringe on the intellectual property rights of others.
I. Hosting and Sharing of Content
Authors may host or share Content on the eBookquet Network platform, provided that:
a. The Content complies with this Intellectual Property Policy, and
b. The Content adheres to the laws and regulations governing digital platforms and online content sharing applicable in the author’s country of residence.
Authors are solely responsible for all Content they upload, host, or share. This includes ensuring the legality, appropriateness, accuracy, and reliability of such Content.
By hosting or sharing Content on eBookquet Network, you confirm that:
a. You own the intellectual property rights or have the appropriate licenses to the Content.
b. You have the legal authority to grant eBookquet Network a license to use the Content in accordance with this Intellectual Property Rights Policy.
c. Your Content does not infringe upon any rights of others, including but not limited to copyrights, trademarks, patents, privacy rights, publicity rights, or any other intellectual property rights, whether tangible or intangible.
II. Author Rights and eBookquet Network License
a. Authors retain full ownership of the Content they upload to the eBookquet Network platform. It is your responsibility to protect and enforce your rights to your Content.
b. By uploading or sharing Content, you grant eBookquet Network a non-exclusive or exclusive and worldwide license (based on the signed license agreement) to host, publicly display, distribute, and share your Content with other users, strictly in accordance with this Intellectual Property Rights Policy.
III. Platform Moderation Rights
a. By hosting Content on the platform, you acknowledge and agree that:
eBookquet Network has the right, but not the obligation, to moderate, review, or remove any Content at its sole discretion, particularly if such Content is found to violate this IPR Policy or any applicable law.
eBookquet Network assumes no liability or responsibility for any Content that is hosted or shared by users, nor does it guarantee the accuracy, integrity, or quality of such Content.
v. Content Distribution
Content on eBookquet Network Application is sold on as-is basis without warranties of any kind, either expressed or implied. Refunds and payment terms are subject to this IPR Policy and the Terms and Conditions.
vi. Content Availability: Content owners and rights holders have the authority to set pricing and control the availability of their content, except in cases where such control conflicts with:
• Users’ paid subscription or acquisition rights,
• Copyright infringement concerns, or
• Technical issues beyond eBookquet Network’s control.
a. Content Access: Users can access content such as e-books, courses, publications, and other materials by creating and logging into their accounts. Users may choose from available payment plans to access paid content or access free content directly.
b. Access Rights: Access rights to the content are governed by the specific terms of access tied to each content item, as well as by eBookquet Network’s overall content access terms and conditions. Access may be restricted if the content violates copyright policies or if technical issues arise that are outside eBookquet Network’s control.
vii. Content Responsibility
The content and other materials available on eBookquet Network Application, both free and premium, are uploaded by various content owners and contributors. We do not promise or guarantee the accuracy, completeness, or reliability of the content provided. Therefore, content users are advised to verify any information independently before placing reliance on it.
viii. Educational Purpose:
The content and materials provided are strictly for educational and informational purposes and shall be so strictly, construed. They do not constitute professional advice of any kind (e.g., legal, medical, financial, etc.).
ix. Limitation of Liability:
eBookquet Network and its administrators shall not be held liable for any errors, omissions, or inaccuracies in the content or for any damage or damages arising from the use of the content and/or third-party services provided.
User-generated Content
User-generated content refers to any form of content, such as text, images, videos, thoughts, experiences, and opinions, or audio files, created and shared by users on eBookquet Network Applications or Websites. Users are solely accountable for all content they post on or through our services, and it's their responsibility to ensure it complies with applicable laws and our community guidelines, ensuring its accuracy, appropriateness, and legality.
When you post content through our Service, you guarantee that:
1. You own the content or have the necessary permissions to use and share it, giving us the rights outlined in our Intellectual Property Rights Policy.
2. Your content does not violate anyone's privacy, publicity, copyright, or contractual rights. If we find that you are infringing on these rights, we may delete your account.
You represent and warrant that you own, protect, or otherwise control all of the rights to the content that you post and that the content is accurate, and its use does not violate this Intellectual Property Rights Policy. Content posted by you or third parties on our Application and Website is not endorsed or guaranteed by us. We disclaim all responsibility and liability for such content.
By submitting user-generated content to our website/application (e.g., reviews, comments, forum posts, custom or collaborative content), you grant eBookquet Network a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content.
Disclaimer
Content uploaded by third-party contributors is not endorsed or verified by us. We disclaim all liability and shall not be liable for any disputes or issues arising from such user-generated content.
Excerpts and Notes
Users may take excerpts or notes from books for private, non-commercial purposes, provided that such use constitutes fair use or dealing under applicable copyright laws.
Public Domain: When a book or content has fair-use status, authors and users are at liberty to use the content freely, either by reproduction, editing, etc. Therefore, no single author has intellectual property rights over such content, or when information from the content is being reproduced by different authors.
However, while the content of public domain works themselves are free to use, the way they are presented—such as in the form of a new book or as part of a collection—can itself be subject to copyright if sufficient originality is added in the form of commentary, illustrations, or critical analysis. Therefore, authors must create enough new content to distinguish their version of the public domain work from others to claim copyright over the new content they have introduced.
By using public domain content, authors understand that others may create similar works based on the same material. Authors waive any claims to compensation or negotiation rights with the eBookquet Network regarding such instances
Prohibited Use: Users shall not use excerpts or notes for commercial purposes or in a manner that infringes on the intellectual property rights of content owners. Users shall not:
i. copy, modify, or distribute content outside the policy.
ii. use the Application for unauthorized purposes.
iii. infringe on third-party intellectual property rights.
iv. share content that encourages or promotes terrorism, pedophile, racism, discrimination, and offensive acts.
v. violate national or international laws or regulations.
vi. exploit, harm, or attempt to exploit or harm minors through inappropriate content or other means.
vii. send unsolicited advertising, promotional materials, spam, or chain letters.
viii. impersonate eBookquet Network staff, other users, or entities.
ix. engage in conduct that restricts others' use or enjoyment of services, or potentially causing harm, offense, or liability to eBookquet Network or its users.
Copyright Verification and Uploading Content
When uploading content or any other materials to eBookquet Network, you may be required to submit verifiable copyright ownership information if eBookquet Network is not satisfied with the available information in your account and the content. Authors could be required to provide amongst others any or all of the following to verify their content before granting access to upload content in their bookstores:
• Authorship or publishing rights documentation.
• Submit credible information on where the materials were or are published.
• Prove that there are no legal or copyright infringements on the materials
• Provide an indemnity cover in favour of eBookquet Network.
• Any other methods required by law in the region or country of the account holder
We reserve the right to review and verify content for acceptance and may reject any material that fails to comply with our policies.
Uploaded Content
To ensure compliance with all intellectual property and copyrights and any other relevant laws, authors who intend to upload content on eBookquet Network MUST comply with the Content Upload Policy and Copyright Verification Requirements for the copyright ownership of books, either for free distribution, sale, and/or rentals. Below are the guidelines after content verification (if necessary) before eBookquet Network grants access to authors or publishers for content uploading in their bookstores.
• Content Use: The content shall have copyrights, or meet public domain works conditions, including Creative Commons Licenses, expired copyrights, open-source, and/or verified fair-use permissions or rights holders by the author, publisher, or acceptable sources to redistribute the content.
• Book Format: eBookquet Network only accepts PDF and EPUB of high quality, virus-free, and readable.
• Content License Agreement: All authors must accept a Content License Agreement with eBookquet Network to give eBookquet Network the right to host, publicly display, and distribute the content.
• Content Status Notice: Authors must include a content status notice in their uploaded content, where applicable.
Content Auditing: eBookquet Network carries out periodic audits to ensure the e-books, or content uploaded on its applications, meet the Intellectual Property Rights Policy and the applicable laws.
Content License Agreement
Below is a sample of a Content License Agreement every author must accept before uploading any content in the bookstore.
Non-Exclusive Content License Agreement
This license agreement is made between [Name] (the "Licensor") and eBookquet Network (the "Licensee") for the use of digital content titled [Content Title]. This agreement allows eBookquet Network to host, publicly display, and distribute the content in digital format, offering [Licensor] broad reach and control over pricing, marketing, and royalties.
License Agreement Terms:
i. Granted Rights: The Licensor has the copyrights and grants the Licensee a non-exclusive license to use, display and distribute the [Content Title] in digital format.
ii. Format Rights: The Licensee shall have the right to use the [Content Title] in digital format, including but not limited to e-books and online streaming.
iii. Territory Rights: The Licensee shall have the right to publicly display and distribute the [Content Title] worldwide.
iv. Termination Rights: The license shall be in effect as long as the content remains on eBookquet Network applications and it is accessible to users, except;
a. it violates the Terms of this Agreement and/or eBookquet Network Terms of Services.
b. you remove the content from eBookquet Network applications.
c. if there is copyright infringement.
d. there is a court order or lawful directive from a statutory or administrative body.
v. Reversion Rights: Once the license agreement is terminated, the rights to the content shall revert to you. However, all active access subscriptions shall remain accessible to the subscribers until they expire.
vi. Access Payment: You will receive and track users’ access payments in your account wallet.
Pricing Model: eBookquet Network operates an access-commission pricing model for content access. eBookquet Network takes the following commissions on book usage:
a. Rental access –25% commission per rental.
b. Buy access –30% commission per purchase.
vii. Royalty: Royalties will be paid to content owners after 30 days for every payment receipt.
a. Rental access –75% royalty per rental.
b. Buy access –70% royalty per purchase.
Copyrights Verifications
You may be required to submit verifiable copyright ownership information if eBookquet Network is not satisfied with the available information in your account and the content.
Content Policy
To ensure compliance with all intellectual property and copyrights and any other relevant laws, authors who intend to upload content on eBookquet Network must read and comply with our Intellectual Property Rights Policy.
Change Notification: You will be notified accordingly if any changes to these terms require your acceptance of a new agreement.
Copyright Infringement Reporting
Copyright infringement happens when someone uses a copyrighted work without permission, violating the rights of the copyright holder. This can include unauthorized reproduction or distribution of copies. If it becomes a legal case, the original creator has to prove their rights were infringed. The outcome can affect the author's control over their work and their earnings.
How to Report Copyright Infringement
If you believe your copyrighted work has been used in a way that constitutes copyright infringement on our applications, you can report it. Copyright owners or right holders can flag infringing content directly from their BookHut or Knet Mart. The alleged infringer will be notified and given seven days to remove the content. If they do not, you can submit a formal claim using our Copyright Complaint Claim Form.
Note that making false or bad-faith claims may result in damages, including costs and attorneys' fees.
When you receive a Copyright Complaint
When you receive a copyright complaint, access to the specified content will be restricted. Please review the copyright complaint we sent you, which includes details about the complaint and instructions on filing a counter-notice. Ensure you are regularly checking the email address associated with your eBookquet Network account for updates.
Note: If you are sure the copyright complaint has merit, removing the content from eBookquet Network platform may resolve the complaint.
Infringement and Takedown {Nigerian Copyright Act 2022 –Section 36(a) –(g)}
Any breach of eBookquet Network’s Uploaded Content Policy or a report of unlawful use of intellectual or prohibited materials will result in the suspension of the materials in line with our IPR Policy and the applicable laws. The infringing content will be taken down and/or the account will be suspended, and the account holder might be reported to the relevant agency or be charged for copyright infringements in line with the subsisting laws of the region or country of the account holder.
Takedown Procedure
We will respond to valid takedown notices and remove infringing content in accordance with applicable laws and regulations.
Takedown Notice: If you strongly believe there is an infringement on your content, prepare a takedown notice containing the following information:
• a physical or electronic signature of the person authorized to act on behalf of the owner of the right allegedly infringed (i.e., where the complaining party is not the owner of the copyright)
• identification of the copyrighted work
• identification or description of the infringing material or the subject of infringing activity that is to be removed or access to which is to be disabled
• information sufficient to enable the platform owner to locate the infringing content.
• contact information of the complaining party including electronic mail address, telephone number or a location address at which the complaining party may be contacted.
• a declaration on oath that the complainant believes that the use of the material in the manner complained of is not authorized by the owner of the copyright, his agent or by law.
• a statement that the information in the notification is accurate and that the complainant is authorized to act on behalf of the owner of the right allegedly infringed (i.e., where the complaining party is not the owner of the copyright)
Send Takedown Notice: Submit the takedown notice to us via the Copyright Complaint Claim Form, or send via email at info@ebookquet.com. Ensure compliance with relevant laws and regulations.
Takedown Notice Response: When we receive your takedown notice, we will immediately take the following actions in accordance with the law and policies:
• Notify the alleged infringer
• Remove or disable access to infringing content
• Await potential counter-notice
Counter-Notice and Restoration: If you believe the removed content was mistakenly identified or should be reinstated, you can file a counter-notice. Keep in mind that this may lead to a legal process, which may involve disclosing your personal information to the reporting party. Due to potential consequences, consulting an attorney is recommended if you are uncertain. If you file a counter-notice:
• We will send your counter-response to the reporting party immediately.
• We may restore the content if we do not receive any response from the reporting party within seven (7) days after forwarding the counter-notice. Or,
• You may need to take legal action if the infringement is not resolved.
If you file a counter-notice, be aware that if the copyright owner disputes your claim that the content was removed in error or misidentification, they may pursue legal action against you. You can send your counter-notice to us via email at info@ebookquet.com.
Note: Do not re-upload copyrighted content. If you reload copyrighted content, we shall, on becoming aware of such content being reloaded, promptly remove or disable access to the content without further notice to you. Your account may also be permanently suspended. If the removal was a mistake, file a counter-notice.
DMCA Takedown Notice Requirements {Section 512(c)(3)}
If you are a United States resident, you may file your claims according to the Digital Millennium Copyright Act infringement procedure. A valid DMCA takedown notice must include the following elements:
1. Identification of the copyrighted work claimed to be infringed.
2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity.
3. Contact information for the complaining party (e.g., name, address, phone number, email).
4. A statement of good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. A statement of accuracy that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
DMCA Counter-Notice Procedure {Section 512(g)}
If you believe your content was removed incorrectly, they can file a counter-notice with the Online Service Provider (OSP). The counter-notice must include:
1. Identification of the removed content.
2. A statement of good faith belief that the material was removed due to a mistake or misidentification.
3. Contact information for the subscriber (name, address, phone number).
4. A statement consenting to jurisdiction in federal court in the district where the OSP is located.
5. A physical or electronic signature of the subscriber.

Repeated Copyright Infringements
If we receive several copyright complaints about an account or notice a pattern of repeated infringement, we may suspend the account based on our Copyright Policy and in accordance with the applicable law.

Consequences of Violation
Violating our Intellectual Property Rights Policy can lead to account suspension, termination and/or legal consequences.
Intellectual Property Rights Violations
Violation occurs when someone uses another's intellectual property (IP) without permission or legal authority.
Copyright Violation: Using someone else's original content, like text, images, music, or videos, without their consent. This can include:
• Posting copyrighted content or blog posts without permission.
• Using someone else's photos or graphics without a license.
• Sharing copyrighted music or videos without fair use or permission.
Trademark Violation: Using someone else's trademarked logo, brand name, or slogan in a way that can confuse users or dilute the brand. This can include:
• Using a similar logo or branding to deceive users into thinking it's associated with the original brand.
• Selling counterfeit content with a trademarked logo
• Using a trademarked name or slogan in a way that suggests affiliation or endorsement without permission.
Report Violations: Requests for investigation are only accepted from the right-owners or their authorized representatives. You can send us your request to info@ebookquet.com with the relevant and supporting documents.
Consequences
Violating intellectual property (IP) rights can have serious consequences. Therefore, violating our IPR policy can lead to account deactivation. Depending on the violation, you might get a chance to fix the issue and comply with our policies. However, in some cases, your account may be terminated. Some actions may warrant:
• Legal action
• Financial penalties
• Criminal charges
Termination
eBookquet Network may, at its sole discretion, remove content or terminate an account without notice or opportunity for appeal if it reasonably believes:
• Content is false, misleading, or violates policies.
• Intellectual property rights are infringed.
• Applicable laws are breached.
• Content is deemed offensive or harms eBookquet Network's reputation.
• Unauthorized trademarks, logos, or copyrighted material are used.
• Defamation, misrepresentation, or insult of third parties occurs.
• Environmental, human life, or property risks are posed.
• Terrorist or illegal activities are supported.
Payments and Royalties
Our platform allows authors to retain control over their work, including pricing, marketing, and distribution, while protecting their rights and interests. By doing so, we unite readers and authors worldwide, promoting a love for reading and storytelling.
Knowledge Networking Marketplace (Knet Mart)
A hosting place for third-party products and services that connects buyers and sellers –authors, writers, online bookstores, resellers, and publishers –to reach a wider audience by sitting in the middle. Authors leverage the eBookquet Network user traffic and tools to market and sell their content to the target audience.
Billing Model: The billing system is a royalty on the Gross Merchandise Volume (GMV) of sales, and the payment modes are wallet and micropayment. There are two marketplace services:
• Content Buy: This is an outright purchase of content by users.
• Content Rental: A short access for temporary use and quick reference. The borrowing period is flexible and cheaper than outright purchase. The criteria for billing in rental are:
o Length of use
o Number of users
o Seasonal pricing –weekends, holidays, etc.
Payment Policy
We use third-party payment providers globally to process transactions or fund an account wallet on our platform. This means we don't have access to or store any of your personal payment information when you purchase our products or services. Payment Account: eBookquet Networks uses e-wallet, a software-based system that securely stores users’ payments for content. The wallet is linked to an author’s bank account using a secure token to represent the author’s bank account personal details in an encrypted format. The token increases data security, convenience, and streamlines payment processing.
Payment Dashboard: Authors track sales and payments on the account dashboard.
Pricing Model: eBookquet Network operates an access-commission pricing model for content access. eBookquet Network takes the following commissions on book usage:
viii. Rental access –25% commission per rental.
ix. Buy access –30% commission per purchase.
Royalty: Royalties will be paid to content owners after 30 days for every payment receipt.
i. Rental access –75% royalty per rental.
ii. Buy access –70% royalty per purchase.
Refund Policy:
eBookquet Network does NOT refund payment for subscriptions when content is taken down. Vouchers are substituted for active subscriptions.
Rental: When content is taken down for violating eBookquet Network Policy, and there are running rentals, the users will receive vouchers covering ONLY from the time the content was taken down to the end of the subscription. The subscribers can use the vouchers to subscribe to content of their choice.
Buy: If the content was bought, and it was found to have violated the eBookquet Network Policy, the user will get 50% cost of the content as a voucher if the content was purchased within six months, and 30% cost of the content as a voucher if the content was purchased after six months.
Cancellation Policy: There is no cancellation or refund for subscriptions. However, vouchers are substituted for active subscriptions. Therefore, users are expected to check and evaluate their decisions before making payments.
Payment Disputes
Since eBookquet Network does not store or have access to transaction information in the payment provider’s platform, eBookquet Network cannot resolve payment disputes with users. Kindly contact your payment providers and/or intermediary banks for any payment resolution.
Limitation of Liability and Disclaimer
All content uploaded on eBookquet Network is considered safe and secure. All employees of eBookquet Network are held to the highest ethical standards. However, eBookquet Network is not liable for copyright infringement or intellectual property violations by users. Any individuals found to be in breach of this policy will be handled according to eBookquet Network's policy and applicable state laws on intellectual property violations.
Limitation of Liability
• eBookquet Network and its administrators shall not be held liable for any errors, omissions, or inaccuracies in the content or for any damage or damages arising from the use of the content and materials provided.
• eBookquet Network accepts no responsibility or liability for any challenges or issues arising from its application usage resulting from network, computer hardware, or software failures of any kind.
User Responsibility: Authors are solely responsible for ensuring that they have the necessary rights, licenses, and permissions to upload, distribute, and sell content on eBookquet Network Applications. By using the platform, authors acknowledge that they are aware of the risks of copyright infringement and agree to hold harmless eBookquet Network Limited and its affiliates.
No Warranty
eBookquet Network makes no warranty, representation, or guarantee that the content available on its platform does not infringe on any copyright or other intellectual property rights of any third party. eBookquet Network is merely a distributor of content and does not have the ability to verify the ownership or rights of every content.
User-Generated Content: Content uploaded by third-party contributors is not endorsed or verified by us. We disclaim all liability and shall not be liable for any disputes or issues arising from such user-generated content.
Content Terms: The content on eBookquet Network platform is sold on as-is basis without warranties of any kind, either express or implied. Content usage is subject to our Content License Agreement.
Educational Purpose: The content and materials provided are for educational and informational purposes only. They do not constitute professional advice, including but not limited to legal, medical, financial, or other specialized guidance.
Disclaimer
eBookquet Network disclaims any liability for any damage or loss resulting from copyright infringement or other intellectual property rights infringement, including but not limited to direct, indirect, incidental, special, or consequential damage. eBookquet Network makes no warranties or representations regarding the accuracy or completeness of content on our platform.
Indemnity
When you use our services, you are allowed to upload and publish content (including text and images) to your account, as long as you follow our Terms and Conditions. You are also agreeing to protect eBookquet Network from any costs, fines, or claims that might come up if you post anything illegal or infringe on someone's intellectual property rights.
Governing Law and Jurisdiction
Any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way relating to the use of the eBookquet platform, including the interpretation and application of this Policy, shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, and shall be subject to the jurisdiction of Nigerian Courts.
Change and Updates
Our Intellectual Property Rights Policy is subject to change at any time. We will notify users of any updates, and continued use of the platform constitutes acceptance of the updated Policy.
Update Notice: Changes to this policy will be effective immediately upon posting on our website and application.
Acceptance: Using the Application implies acceptance of this Policy. Authors and users also acknowledge that they have read, understood, and agree to be bound by this Intellectual Property Rights Policy.
